Terms of Service
These Terms of Service ("Terms") govern your access to and use of the AlvaxRealtors platform ("Service"), operated by AlvaxRealtors ("we", "us", or "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
Eligibility & Acceptance
You must be at least 18 years old and have a valid, active TikTok account in good standing to use AlvaxRealtors. By using the Service you represent that all information you provide is accurate and that you have the authority to bind yourself to these Terms.
Description of Service
AlvaxRealtors provides a platform that converts two (2) property photographs uploaded by the user into a short-form video and publishes it to the user's connected TikTok account via the TikTok for Developers API.
AlvaxRealtors is an independent third-party application and is not affiliated with, endorsed by, or sponsored by TikTok or ByteDance Ltd. TikTok® is a trademark of ByteDance Ltd.
User Responsibilities
You are solely responsible for:
- Ensuring you own or have the legal right to photograph, advertise, and publish the properties in your uploaded photos.
- Ensuring all content you create through our Service complies with TikTok's Community Guidelines and Terms of Service.
- Ensuring your content does not infringe third-party intellectual property rights, including music, photography, or branding.
- Maintaining the security and confidentiality of your AlvaxRealtors account credentials.
- Any consequences arising from content posted to your TikTok account via our Service.
TikTok API Compliance
Use of the TikTok integration is subject to TikTok's own Terms of Service and Platform Policies. You agree to:
- Use TikTok posting features only for lawful purposes consistent with TikTok's Platform Terms of Service.
- Not use our Service to post spam, misleading listings, or content that violates TikTok's Community Guidelines.
You acknowledge that TikTok may remove posts, restrict or suspend accounts, or revoke API access at their sole discretion. AlvaxRealtors bears no liability for such actions by TikTok.
Acceptable Use
You may not use AlvaxRealtors to:
- Post fraudulent, deceptive, or misleading property listings.
- Upload photos of properties you do not have authorization to market.
- Attempt to reverse-engineer, hack, or disrupt the Service.
- Circumvent usage limits or billing systems.
- Use the Service for any purpose other than real estate marketing.
We reserve the right to suspend or terminate accounts that violate these conditions without prior notice.
Billing & Cancellation
- Paid plans are billed monthly in advance. All fees are in USD.
- Cancellations take effect at the end of the current billing period. Access to paid features continues until then.
- We do not offer refunds for partial billing periods.
- Free plan users may be subject to usage limits and feature restrictions.
- Pricing is subject to change with 30 days advance notice by email.
Intellectual Property
You retain full ownership of your uploaded photos. By uploading, you grant AlvaxRealtors a limited, non-exclusive, royalty-free license to process them solely for the purpose of generating your requested video.
AlvaxRealtors and its licensors retain all rights to the platform, technology, generated video templates, and all related intellectual property. You may not copy, modify, or distribute our platform or its components.
Disclaimer of Warranties
The Service is provided "as is" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that videos will achieve any particular reach or engagement on TikTok.
Limitation of Liability
To the maximum extent permitted by applicable law, AlvaxRealtors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of revenue, loss of data, or loss of business opportunities.
Our maximum aggregate liability for any claim arising from the Service is limited to the total fees you paid in the three (3) months preceding the claim.
Changes to These Terms
We may update these Terms from time to time. We will notify you via email or in-app notice at least 14 days before material changes take effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
